1. Acceptance of Terms

By accessing and using the DistilledScience Topic Voter application (“Service”), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Description of Service

DistilledScience Topic Voter is a web application that allows users to vote on potential video topics and submit their own topic suggestions for consideration by DistilledScience content creators. The Service is provided free of charge for personal, non-commercial use.

3. User Accounts and Registration

3.1 Account Creation

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must be at least 13 years old to create an account.
  • One account per person; multiple accounts by the same individual are prohibited.

3.2 Account Security

  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. User Conduct and Content

4.1 Acceptable Use

  • Use the Service only for lawful purposes.
  • Respect the voting limits (3 votes per day per registered user).
  • Submit original topic ideas that do not infringe on others’ intellectual property.
  • Interact respectfully with other users and the platform.

4.2 Prohibited Content

  • Contains hate speech, harassment, or discriminatory content.
  • Promotes illegal activities or violence.
  • Infringes on intellectual property rights.
  • Contains spam, malware, or malicious links.
  • Violates any applicable laws or regulations.
  • Is sexually explicit or inappropriate.
  • Contains personal information of others without consent.

4.3 Content Ownership and License

  • You retain ownership of topic ideas you submit.
  • By submitting content, you grant DistilledScience a non-exclusive, royalty-free, perpetual license to use, modify, and create derivative works from your submissions.
  • DistilledScience may use submitted topics for video creation, promotional materials, and platform improvement.
  • You represent that you have the right to grant these licenses.

5. Voting System

5.1 Voting Rules

  • Registered users receive 3 votes per day.
  • Votes reset daily at midnight UTC.
  • Users cannot vote on their own submitted topics.
  • Voting manipulation or bot usage is strictly prohibited.

5.2 Topic Selection

  • Topic votes influence but do not guarantee content creation.
  • DistilledScience reserves final editorial discretion over all content.
  • Popular topics may be adapted or modified for video production.

6. Intellectual Property

6.1 Platform Rights

  • The Service, including its design, code, and functionality, is owned by DistilledScience.
  • Users may not reproduce, distribute, or create derivative works of the platform.
  • All trademarks and service marks are property of their respective owners.

6.2 User Submissions

  • Users warrant that submitted content is original or properly licensed.
  • Users indemnify DistilledScience against any claims related to submitted content.
  • DistilledScience may remove content that violates intellectual property rights.

7. Privacy and Data Protection

7.1 Data Collection

  • We collect minimal personal information necessary for Service operation.
  • Email addresses are used for account verification and notifications.
  • Voting patterns and topic submissions are tracked for platform improvement.

7.2 Data Use

  • Personal information is not sold or shared with third parties without consent.
  • Aggregated, anonymized data may be used for analytics and improvements.
  • Users may request data deletion by contacting support.

8. Service Availability and Modifications

8.1 Service Availability

  • The Service is provided “as is” without guarantees of uptime or availability.
  • We may temporarily suspend the Service for maintenance or improvements.
  • We reserve the right to modify or discontinue features at any time.

8.2 Platform Changes

  • These Terms may be updated periodically.
  • Users will be notified of material changes via email or platform notification.
  • Continued use after changes constitutes acceptance of new terms.

9. Termination

9.1 User Termination

  • Users may delete their accounts at any time.
  • Account deletion does not revoke licenses granted for previously submitted content.

9.2 Platform Termination

  • We may suspend or terminate accounts for Terms violations.
  • We may terminate the Service entirely with 30 days’ notice.
  • Upon termination, user access rights cease immediately.

10. Disclaimers and Limitations

10.1 Disclaimers

  • The Service is provided “as is” without warranties of any kind.
  • We disclaim all warranties, express or implied, including merchantability and fitness for purpose.
  • We do not guarantee that submitted topics will be used for video creation.

10.2 Limitation of Liability

  • Our liability is limited to the maximum extent permitted by law.
  • We are not liable for indirect, incidental, or consequential damages.
  • Total liability shall not exceed $100 or the amount paid for the Service (currently $0).

11. Indemnification

You agree to indemnify and hold harmless DistilledScience, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Your submitted content.
  • Your violation of any third-party rights.

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of [Insert Jurisdiction], without regard to conflict-of-law principles.

12.2 Dispute Resolution

  • Disputes should first be addressed through good-faith negotiation.
